A common assumption in the selection of nonhuman animal subjects for research and the approval of research is that, if the risks of a procedure are too great for humans, and if there is a so-called scientific necessity, then it is permissible to use nonhuman animal subjects. I reject the common assumption as neglecting the central ethical issue of the permissibility of using nonhuman animal subjects and as being inconsistent with the principle of justice used in human subjects research ethics. (...) This principle requires that certain classes of individuals not be subjected to a disproportionate share of the burdens or risks of research. I argue for an extension of this principle to nonhuman animal research and show that a prima facie violation of the principle occurs because nonhuman animals bear an overwhelmingly disproportionate share of the risks of research without sufficient justification or reciprocal benefit. Ethics training is becoming increasingly common in pre-professional contexts to address ethical misconduct in business, medicine, science, and other disciplines. These courses are often taught by philosophers. The question is whether such ethics training, which involves philosophical reflection, is effective in cultivating ethical behavior. This paper takes a closer look at the goals of teaching ethics and how our current methods are ineffective in achieving the affective and active goals of teaching ethics. This paper then suggests how experiential learning and, (...) specifically, service learning may be one way forward in achieving these goals. While some pre-professional programs have implemented service learning, the ethics courses offered by philosophers also may be improved by giving students more opportunities to engage their communities through service learning. Undocumented immigrants are ineligible for most federally funded public benefits programs with few exceptions such as emergency medical assistance and nutrition assistance for women and children. This paper defends the view that a liberal society should provide greater access to undocumented immigrants to public benefits programs and responds to an important economic objection that a state should be able to prioritize the needs of its own members who contribute to these programs. This paper specifically addresses empirical and moral versions of (...) this objection. It also distinguishes between two kinds of public benefits. Certain public benefits, such as social security, may reflect an agreed-upon distribution of public goods, to which people are entitled based on their membership or contribution. Other public benefits, such as nutrition assistance, are set aside primarily to help people based on their need. In the latter case, it is not membership or contribution, but need or which need is greater, that supplies justification for the distribution of these benefits even when resources are limited. Son institutionnalisation progressive, par la création de la Commission nationale du débat public, correspond à la volonté d'intégrer des acteurs différents autour d'une discussion au plus près des instances d'exécution de la politique publique. Elle est révélatrice d'une tension entre deux modes de conception de la communication en politique, l'une délibérative et l'autre instrumentale. Ainsi, bien que la création de la CNDP corresponde incontestablement (...) à un élargissement de la palette des modalités d'expression démocratique et contribue à la diffusion d'une « culture du débat » en France, il reste que son ancrage dans le processus décisionnel reste problématique et encore contesté par de nombreux élus.Past fifteen years have seen the emergence in France of a model of public debate relatively original. Its progressive institutionalization by creating the National Commission for public debate is the desire to integrate different actors around a closer discussion of the enforcement of public policy. United Nations (UN) leaders suggest that the world is not on track to meet the Sustainable Development Goals (SDGs) by 2030. The purpose of this paper is to explore whether the SDGs provide a valuable platform to call for a basic income (BI) globally. Adopting a critical historical studies approach, the article traces the evolution of ‘development’, including the UN decades of development, the Millennium Development Goals, and the SDGs. It subsequently describes the structural adjustment and poverty reduction efforts by (...) the World Bank and International Monetary Fund, and then outlines why the SDG framework may be helpful in advancing a BI. We argue that as climate-related disasters increase, a BI will be vital in providing a modicum of security in an increasingly unstable world. Calls for BI must be anchored to a broader change agenda that recognizes the causes of poverty and income inequality, and seeks their dismantling and redress. (shrink)

We provide an overview of Searle's contributions to speech act theory and the ontology of social reality, focusing on his theory of constitutive rules. In early versions of this theory, Searle proposed that all such rules have the form 'X counts as Y in context C' formula – as for example when Barack Obama (X) counts as President of the United States (Y) in the context of US political affairs. Crucially, the X and the Y terms are here identical. A (...) problem arises for this theory for cases involving 'free-standing Y terms', as for example in the case of money in a computerized bank account. Here there is no physical X to which a status function might be attached. We conclude by arguing that Searle's response to this problem creates difficulties for his naturalistic framework. (shrink)

Este artículo busca identificar las razones que llevaron a Hume a adoptar lo que él llamó escepticismo mitigado. En primer lugar defiende que nadie empieza a filosofar siendo un escéptico, ni siquiera cuando adopta un escepticismo antecedente de tipo cartesiano. En segundo lugar arguye que Hume juzgó que los argumentos escépticos tradicionales, basados en el método de la antinomia, incluso los de Bayle, no son decisivos para convertir a alguien en un escéptico, ya que en general admiten respuesta y son (...) débiles. Después de establecer la confianza de Hume en su ciencia empírica de la naturaleza humana, muestra, en tercer lugar, que los buenos argumentos que pueden llevar a alguien a adoptar el escepticismo están basados en los descubrimientos de esa ciencia. Es fundamental percatarse de que esa ciencia denuncia los principios del entendimiento como imperfectos, involucrando errores, confusiones, falacias y contradicciones. Así, Hume revela la importancia que el empirismo y la doctrina de los ídolos de Bacon tuvieron para su escepticismo mitigado. The project of a naive physics has been the subject of attention in recent years above all in the artificial intelligence field, in connection with work on common-sense reasoning, perceptual representation and robotics. The idea of a theory of the common-sense world is however much older than this, having its roots not least in the work of phenomenologists and Gestalt psychologists such as Kohler, Husserl, Schapp and Gibson. This paper seeks to show how contemporary naive physicists can profit from a (...) knowledge of these historical roots of their discipline, which are shown to imply above all a critique of the set-theory-based models of reality typically presupposed by contemporary work in common-sense ontology. Civil disobedience is a conscientious, unlawful, and broadly nonviolent form of protest, which most political philosophers and many non-philosophers are inclined to treat as potentially defensible in democratic societies. In recent years, philosophers have become more receptive to long-standing complaints from activists that civil disobedience is an unduly restrictive framework for considering the ethics of dissent. Candice Delmas and Jason Brennan have written important books that illustrate and strengthen this trend, both defending forms of “uncivil” resistance that go beyond the (...) narrow confines of civil disobedience. Their books offer contrasting but complementary philosophical defences of incivility as a tactic of resistance, but it is nonetheless a mistake to conclude that the rich tradition associated with civil disobedience no longer has any relevance for resistance in national, transnational, and global contexts. SmithIn his writings on Nietzsche, Pierre Klossowski makes use of various concepts—such as intensities, phantasms, simulacra and stereotypes, resemblance and dissemblance, gregariousness and singularity—that have no place in Nietzsche's own oeuvre. These concepts are Klossowski's own creations, his own contributions to thought. Although Klossowski consistently refused to characterize himself as a philosopher ("Je (...) suis une 'maniaque,'" he once said, "Un point, c'est tout!"),1 his work in its entirety was marked by an extraordinary conceptual creation. From this point of view, his Nietzsche and the Vicious Circle can be read as a work in philosophy—at least in the idiosyncratic sense given to this term by Gilles Deleuze, who defined philosophy as the creation or invention of concepts [Deleuze and Guattari 2]. No doubt, Klossowski remains an almost unclassifiable figure—philosopher, novelist, essayist, translator, artist—and attempting to analyze his work through the prism of philosophy may seem to be a reductive approach that belies the complexity of his exceptional oeuvre. Reading Klossowski as a conceptual innovator, however, at least has the advantage of allowing us to chart a consistent trajectory through his difficult and often labyrinthine text, without denying its other dimensions (affective, perceptive, literary, and so on). In what follows, then, I would like to examine three of Klossowski's most characteristic and important concepts—impulses and their intensities, phantasms, and simulacra and their stereotypes—as well as the precise interrelations he establishes among them. Taken together, these three concepts describe what Klossowski terms the tripartite economy of soul, which constitutes the implicit model through which he interprets Nietzsche's thought.1Impulses as Fluctuating IntensitiesKlossowski describes his books on both Nietzsche and Sade as "essays devoted not to ideologies but to the physiognomies of problematic thinkers who differ greatly from each other" ["Postface" 137, emphasis added]. This emphasis on the "physiognomy" of thinkers reflects Nietzsche's insistence on taking the body rather than the mind as a guide for philosophy since the body is a more accessible phenomenon, less surrounded by myth and superstition. "The body and physiology as the starting point," Nietzsche wrote. "Why?... The phenomenon of the body is the richer, clearer, more tangible [End Page 8] phenomenon.... Belief in the body is more fundamental than belief in the soul" [WP §§492, 489, 491]. Klossowski himself, however, when writing of the intensive status of the impulses, frequently makes use of the term "soul" (âme), owing in part, no doubt, to his interest in the theological literature of the mystics, such as Meister Eckhardt and Teresa of Avila. For the mystics, the depth of the soul is something irreducible and uncreated: it eludes the exercise of the created intellect, and can only be grasped negatively.2 Nonetheless, if one can find a similar apophaticism (or "negative theology") in Klossowski, it is related exclusively to the immanent and chaotic movements of the soul's intensive affects, and not to the transcendence of God. What is incommunicable in the soul (or body) are its "impulses"—their fluctuations of intensity, their rises and falls, their manic elations and depressive descents, which are in constant variation.Nietzsche himself had recourse to a highly varied vocabulary to describe what Klossowski summarizes in the term "impulse": "drive" (Triebe), "desire" (Begierden), "instinct" (Instinke), "power" (Mächte), "force" (Kräfte), "impulse" (Reize, Impulse), "passion" (Leidenschaften), "feeling" (Gefülen), "affect" (Affekte), "pathos" (Pathos), and so on.3 Klossowski frequently employs the musical term tonalité to describe these states of the soul's fluctuating intensities—their diverse tones, timbres, and changing amplitudes—which can take on various forms ("aggressiveness, tolerance, intimidation, anguish, the need for solitude, the forgetting of oneself" [NVC 6]). : In prior essays I have sketched a “modal model” of consciousness. That model “factors” out several distinct forms of awareness in the phenomenological structure of a typical act of consciousness. Here we consider implications of the model à propos of contemporary theories of consciousness. In particular, we distinguish phenomenality from other features of awareness in a conscious experience: “what it is like” to have an experience involves several different factors. Im folgenden werde ich versuchen zu zeigen, wie es möglich ist, die Common-Sense-Welt als ontologisch eigenständiges Untersuchungsobjekt zu verstehen. Per Husserl, come per Bolzano, la logica e una dottrina della sdenza. Husserl prende pero piu sul serio l'idea che le teorie scientifiche siano costituite dagli atti mentali di soggetti conoscenti. Quella che segue e un' esposizione della concezione husserliana della logica e della scienza, fondata appunto sugli atti; essa approdera a una delineazione dell'idea husserliana di «ontologia formale».

Los intérpretes han dividido la filosofía de Hume, su “lógica”, en dos partes: la destructiva, compuesta por sus análisis filosóficos, su crítica del racionalismo y sus momentos escépticos; la constructiva, que contiene su asociacionismo psicológico, su ciencia empírica de la naturaleza humana y sus momentos naturalistas o realistas. Mi intención es cuestionar cualquier interpretación que suponga esa dicotomía, y mostrar que Hume realiza ambas tareas al mismo tiempo, en etapas sucesivas. This interview, conducted over the span of several months, tracks the respective journeys of Constantin V. Boundas and Daniel W. Smith with the philosophy of Gilles Deleuze. Rather than “becoming Deleuzian,” which is neither desirable nor possible, these exchanges reflect an array of encounters with Deleuze. These include the initial discoveries of Deleuze’s writings by Boundas and Smith, in-person meetings between Boundas and Deleuze, and the wide-ranging and influential philosophical work on Deleuze’s concepts produced by both Boundas and (...) Smith. At stake in this discussion are key contributions by Deleuze to continental philosophy, including the distinction between the virtual and the actual and the very nature of a “concept.” Also at stake is the formative or pedagogical impact of a philosopher, like Deleuze, on those who find and fully engage with his texts, concepts, and project. Cette interview, menée sur plusieurs mois, suit les parcours respectifs de Constantin V. Boundas et Daniel W. Smith avec la philosophie de Gilles Deleuze. Au lieu de « devenir Deleuzien, » ce qui n’est ni souhaitable ni possible, ces échanges reflètent un éventail de rencontres avec Deleuze. Il s’agit notamment des premières découvertes des écrits de Deleuze par Boundas et Smith, des rencontres en personne entre Boundas et Deleuze, et du travail philosophique vaste et in????luent sur les concepts de Deleuze produit par Boundas et Smith. Drawing from both theoretical and empirical research, the literature on basic income (BI) is now voluminous, pronouncing both its merits and its limitations. Burgeoning research documents the impacts of un/conditional cash transfers and negative income tax programs, with many studies highlighting the effectiveness of these programs in reducing poverty, and improving a host of social, economic and health outcomes. We consider possible avenues for BI architecture to be adopted within Canada’s existing constellation of income security programs, to the benefit of (...) disadvantaged groups in society. Identifying key federal and provincial (i.e., Ontario) transfer and tax benefit programs, we highlight which programs might best be maintained or converted to a BI. While opponents decry the (alleged) exorbitant costs of BI schemes, we suggest that the existing approach not only produces an ineffective system—which actually engenders poverty and the health and social problems that accompany it—but an excessively costly one. Nous disposons déjà d’autres études sur Brunschvicg, mais c’est seulement à la suite d’un accord entre la France et la Russie, au début des années 1990, que ses archives personnelles, saisies une première fois par les Allemands, puis une deuxième fois par les Soviétiques, sont revenues d...

Ce travail tente de prendre la mesure de certaines des évolutions les plus significatives qui, sous le nom de "post-structuralisme", ont pu affecter la philosophie et la culture contemporaine dans son ensemble. On a choisi de privilégier des lectures suivies d'oeuvres de Deleuze, Derrida et Lyotard, qui servent de fil directeur tout au long de l'étude. L'accent est d'abord mis sur deux gestes caractéristiques, qui ont contribué à modifier, de façon décisive, à la fois le sens et le style des (...) démarches philosophiques ultérieures. D'une part, la mise à mal d'un certain style d'ambition fondatrice : il n'y a ici déplacement qu'à se situer dans un espace d'après la phénoménologie, point de départ d'une série de mouvements d'éloignements, parallèles quoique différenciés, par rapport aux exigences fondationnalistes, encore à l'horizon des recherches génétiques husserliennes ou post-husserliennes. D'autre part, un travail d'accompagnement critique du structuralisme ethno-linguistique : c'est l'occasion de repositionnements et de renouvellements féconds ; la voie est ainsi ouverte pour des développements philosophiques d'un type nouveau, à la fois résolument critiques et ouverts sur leur dehors. On se propose ici d'expliciter le sens et la portée de ces déplacements, dont rend notamment compte la récurrence thématique, dans la position des problèmes philosophiques contemporains de ces élaborations, du couple "genèse et structure". In 2003, Unilever and Oxfam embarked on a groundbreaking “learning project” designed to better understand the impacts of business on poverty. Developing countries were seen as an essential component of Unilever’s corporate strategy, with developing and emerging markets forecast to account for 90% of the world’s population by 2010. Unilever had long been present in many of these markets and increasingly had come to see that its future growth would depend upon its contribution to addressing issues of social and economic (...) development in developing countries, including poverty. Oxfam, one of the world’s most prominent nongovernmental organizations (NGOs), was focused in its campaigning and other activities on the alleviation of poverty. Thus, despite the often adversarial relationship between corporations and NGOs, the two organizations shared a common interest and this formed the basis for their collaboration. The goal was to examine the role of business in poverty reduction and study, specifically, Unilever’s operations in Indonesia. The Unilever and Oxfam (A) case describes how this collaboration came about and provides background on Unilever, Unilever Indonesia (UI) and Oxfam, including its recent campaigns against the pharmaceutical and coffee industries. It also examines the role of NGOs and outlines the challenge of poverty in developing countries, the Millennium Development Goals, and the UN Global Compact. The case shows the difficulties inherent in better understanding the role of MNCs in poverty alleviation as well as in formulating an effective collaboration between corporations and NGOs. (shrink)

The work of Michel Foucault sees modern penal technology as an expression of power that operates through and is motivated by a dry instrumental reason. This article draws upon Durkheim and Bakhtin to advance a radically alternative approach. It is suggested that such technology is invested with sacred and profane symbolism and is understood via emotion-ally charged, dramatically compelling narrative frames. Tensions between official and un-authorized discourses can be understood through a center/periphery model of culture. In an extended case study (...) of the guillotine, it is shown that the apparatus was initially legitimated as an expression of a sacred revolutionary code. Such a discourse was subsequently destabilized by popular medical debates that raised the specter of pain after decapitation. While inconclusive, these new motifs mobilized Gothic and grotesque themes that confronted the rationalist aesthetics of the guillotine. A situation of Bakhtinian heteroglossia eventuated. Uncertainty, the uncanny and fable entered a discursive field of increasing complexity. (shrink)

Why has comedy become one of our most abiding ethical preoccupations as well as a dominant mode of political critique? It is suggested that comedy appeals to contemporary persons because it provides an apt social-aesthetic form through which to face up to living with others at a time when it is hard to bear others or otherness. The article outlines an ethics of modern individuality by developing a theory of comedy as more about building social bonds and finding out what (...) could be shared knowledge and experience than the toppling of dominant modes of thought or repudiating our mutuality with others. Drawing on Georg Simmel’s ‘The Law of the Individual’, the article develops a Simmelian reading of Freud’s Jokes to argue that comedy is one solution to resolving our mutual un-alikeness by way of forging knotted paths toward recognising how we could be alike. El presente artículo continua con investigación publicada el año pasado sobre la indagación en torno a la presencia en Jorge Millas de asuntos y problemas propuestos por Bergson. Consigna sus diferencias sobre la relación entre intuición e inteligencia, y sobre la posibilidad de un sistema filosófico. Constata un acuerdo de raíz espiritualista sobre el valor ético de la filosofía y su incompatibilidad con todo dogmatismo y reduccionismo.

Un mince fil dans la vaste littérature sur Kafka concerne la connaissance qu’avait Kafka de la philosophie, et plus précisément l’utilisation, dans les récits de Kafka, de quelques-unes des idées principales de Franz Brentano. Kafka a suivi des cours de philosophie à l’Université Charles, cours donnés par des étudiants de Brentano, Anton Marty et Christian von Ehrenfels. Il fut aussi, pendant plusieurs années, membre d’un groupe de discussion organisé par des partisans orthodoxes de la philosophie brentanienne à Prague. Le présent (...) essai résume ce que l’on sait des relations entretenues par Kafka avec le mouvement brentanien. Il porte sur les idées brentaniennes qui concernent l’évidence de la perception intérieure, la conscience oblique, l’introspection active, le jugement correct et incorrect et la conscience en tant qu’espèce de tribunal intérieur, dans le but d’éclairer certains aspects centraux de l’œuvre de Kafka, incluant son style. Nous porterons une attention particulière sur Die Verwandlung et Der Prozess , et nous offrirons une interprétation de ce dernier texte selon laquelle le procès de Joseph K. se passe entièrement dans l’esprit de K. lui-même.
